Terms of Service

1. Agreement to Terms

By accessing or using Clothset (clothset.com), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms at any time — material changes will be communicated via email or site notice at least 14 days in advance.

2. What Clothset Is

Clothset is a multi-brand fashion marketplace. We provide the platform where buyers can browse, try on virtually, and purchase clothing from multiple brands and sellers in a single checkout. Sellers list their own products and are responsible for fulfillment. Clothset facilitates the transaction, processes payment via Stripe Connect, and takes a platform service fee.

3. Account Registration

• You must be at least 16 years old to create an account.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the security of your login credentials.
• You must notify us immediately if you suspect unauthorized access to your account.
• We may suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Purchases & Payments

• All prices are listed in US dollars (USD) unless otherwise stated.
• A platform service fee of 5% is applied to all purchases. This fee is shown at checkout before you complete your order.
• Payments are processed by Stripe. Your payment card details are sent directly to Stripe and never stored on Clothset servers.
• When your cart contains items from multiple sellers, each seller fulfills their portion of the order independently. Shipping costs and delivery times may vary per seller.
• All sales are subject to product availability. If an item becomes unavailable after you place your order, we will notify you and issue a full refund for that item.
• You are responsible for any applicable sales tax, which is calculated based on your shipping address.

5. Sellers & Marketplace Rules

Sellers on Clothset are independent businesses or authorized resellers. Clothset is the marketplace facilitator, not the seller of record.

• Sellers are responsible for the accuracy of their product listings, including descriptions, images, pricing, and available sizes.
• Sellers are responsible for fulfilling orders, shipping products, and handling returns per their stated return policy.
• Sellers must comply with all applicable laws, including consumer protection, product safety, and intellectual property laws.
• Clothset reserves the right to remove sellers or products that violate these terms, receive repeated complaints, or misrepresent their products.

6. Shipping & Delivery

Shipping times, costs, and carriers vary by seller. Estimated delivery dates are provided as guidance and are not guaranteed. Clothset is not liable for delays caused by carriers, weather, customs, or other events outside our control. If your order has not arrived within a reasonable timeframe, contact us and we will work with the seller to resolve it.

7. Returns & Refunds

• Return policies are set by individual sellers and displayed on each product page. Most sellers offer a 14–30 day return window for unworn items in original packaging.
• To initiate a return, contact the seller through Clothset. The seller will provide return instructions and a shipping label where applicable.
• Refunds are processed within 5–10 business days of the seller confirming receipt of the returned item.
• The platform service fee (5%) is refunded on returned items.
• If a seller fails to resolve a legitimate return or refund request, Clothset may intervene and issue a refund at our discretion.

8. Virtual Try-On & AI Features

• Virtual try-on results are AI-generated approximations. They are meant to help you visualize how garments might look, but do not guarantee exact fit, color accuracy, or final appearance.
• Use of body measurement features requires explicit opt-in consent. See our Privacy Policy for full details on how body data is handled.
• Clothset is not responsible for purchase decisions made based on virtual try-on results.

9. Your Content

When you submit reviews, photos, or other content to Clothset, you grant us a non-exclusive, worldwide, royalty-free license to display that content on our platform. You retain ownership of your content. You must not submit content that is false, defamatory, infringing, or violates any law.

10. Intellectual Property

The Clothset name, logo, website design, and original software are our property and protected by intellectual property laws. Product images, brand names, and trademarks belong to their respective owners. You may not reproduce, distribute, or create derivative works from our platform without written permission.

11. Prohibited Conduct

You agree not to:

• Use Clothset for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to accounts or systems
• Interfere with or disrupt the platform's operation
• Scrape, crawl, or harvest data from the platform without permission
• Circumvent security measures, rate limits, or access controls
• Resell products purchased on Clothset for commercial purposes without seller consent

12. Dispute Resolution

If you have a dispute with a seller, contact us first at support@clothset.com. We will attempt to mediate between you and the seller. If we cannot resolve the issue, disputes between you and Clothset will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13. Limitation of Liability

Clothsetis provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Clothset shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to: items that do not match product descriptions, shipping delays or lost packages, virtual try-on inaccuracies, or seller insolvency. Our total liability for any claim is limited to the amount you paid for the relevant order.

14. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
